HARDI Australia Pty Ltd has collected your personal information for the purpose of providing you with information about the product you have purchased as well as about the accompanying warranty. Other purpose for which your personal information may be used and disclosed by HARDI Australia includes:

• Providing warranty service to you
• Product and service research
• To provide and improve customer service by HARDI Australia
• Statistical analysis and report production
• Marketing of products and services offered to customers.
• Giving accessto direct contact from HARDI personnel.

By signing this form, you consent to HARDI Australia using your personal details for these purposes. Your personal information may also be disclosed to authorise HARDI dealers. Authorised HARDI dealers may change from time to time. Your personal information is important to HARDI Australia and we will do our best to protect it from unauthorised use and disclosure.

Your personal information:
• Will not be disclosed to any person unless authorised by you or if an exception to disclosure applies as listed below.
• Can be accessed by you upon reasonable notice to Hardi Australia and upon reasonable payment of HARDI Australia expenses relating to your access, e.g. photocopying charges and administration costs. No application fee for access will be levied. Exceptions to disclosure may be:
• Disclosure that is required by law or/as required by any lawful authority, e.g. Police or a Court of Law.
• For the purpose of HARDI Australia and authorised HARDI dealers obtaining legal or other professional advice.
• Disclosure to, and use by, a third party in the case of sale, transfer or assignment of the whole part, of the business or undertaking of HARDI Australia or an authorised HARDI dealer or the whole or part of assets.

If you fail to provide HARDI Australia with any personal information, or you provide incomplete information, HARDI Australia may not be able to provide the appropriate level of warranty, service or customer support. HARDI Australia Warranty Terms & Conditions

This warranty policy document is published to assist HARDI authorised dealers in administrating warranty coverage. This document covers HARDI’s limited warranty which may be revised to reflect changes in policies and procedures as they occur.

Warranty Start Date

1. Warranty period starts on the sale date or the date of installation to the first retail customer.
2. Warranty on stock machines: Stock machines are defined as units properly maintained in dealers stock as new. They cannot have been demonstrated. A machine may remain in stock with the full standard machine warranty period. Machines in stock longer than twelve (12) months will have the remaining portion of the normal twelve (12) months standard warranty.
3. Warranty on Demonstrations Machines to support dealer demonstration programs. The warranty will not be activated when a new machine is usedpurely for demonstration until that machine has operated for 100 hours. For each 100 hours of part of that which exceeds the 100 maximum, one month of warranty will be deducted from the machine warranty. This will only apply provided the machine is maintained and serviced as required:

1. The machine is used only as a demonstrator, may not be for hire or rent.
2. The machine has not been in stock longer than 12 months.
3. A demo machine warranty registration has been registered.

Warranty Coverage

• Standard Warranty Coverage: one (1) year.
• The replacement of the faulty parts.
• The repair of the item or goods.
• The payment of the cost of replacing the item or goods.
• The payment of the cost of having the item or goods repaired.
• Items not covered by warranty, but not limited to:
  • Additional labor expenses.
  • Additional working time.
  • Fast-wear parts like diaphragms, valve, nozzles etc.
  • Consumable items like batteries, oil, seals, etc.
  • Freight cost for replacement parts.
  • Accidentally damaged or broken parts.
  • Equipment modifications not authorized in writing by HARDI.
  • Damage due to incorrect storage or improper usage.
  • Replacement of items by persons who is not the authorized HARDI dealership.
  • Loss of time, inconvenience, loss of machine use, or other consequential damage.
  • Machine transportation costs.
  • Oil analysis.
  • Overheating problems caused by debris restricting airflow.
  • Shop supply items such as welding, lubricants, etc.
  • Environmental charges.
  • Over capacity, accidents, misuse, negligence, modifications, in lack of performing maintenance per manufacturers recommendation.
  • Deterioration of gasket, seals, O-rings, electric wiring and connectors, caused by chemicals, sand, or other environmental conditions.

Parts Warranty Policy

Parts are subject to 90 day warranty and to the conditions specified in HARDI parts solution policies and procedures document.

Parts Warranty Claims

Parts warranty claims must have a copy of the original parts sale invoice, a report and the part photo attached to the claim.

Parts Warranty Return Requests

From time to time parts may be requested to be returned for further analysis. The following must be adhered to:

• Don’t return any parts unless requested to do so.
• Don’t return any parts without a return authorisation number.
• Returned parts must be cleaned and fully assembled.
• Parts must be shipped on prepaid basis.
• HARDI will reimburse the dealers for freight on warranty parts where requested to be returned to HARDI.
• The claim would be declined if the claimed parts are not returned within 21 days of request date and authority given to return them.
• Parts must be held in quarantine and tagged with the claim number, for a period of 3 months before disposal.

Warranty Claim Requirements

• All requests for warranty must be in writing on a HARDI Claim Form.
• The claiming parts must clearly state an issue date and time.
• All claiming parts will have to offer clear photos, before and after showing details of the affected area.
• Claims must include the part numbers and batch numbers where provided.

Claim Submission

• Claims must be received within 21 days of the repair date. Claims received by HARDI after 21 days of the repair date will be considered to be late and there will be no exceptions to this policy.
• Claim must not cover multiple serial numbers. Only one claim per warranty claim form.
• Claims returned for resubmitting must be corrected and returned within 21 days of the date of return. Claims not received within 21 days will be declined.
• Claims can only be submitted two (2) times. If after the second time, the claim is not correct in providing the information as requested, it will be declined and nofurther consideration will be given.

Parts Reimbursement

• Authorised dealers will receive a base discount reimbursement for all parts accepted under normal warranty. But there will not be any further consideration for customs, duty, or brokerage fees.
• No reimbursement will be given for freight, or parts surcharges, that may be incurred in obtaining parts for warranty.
• Parts used for warranty repairs purchased outside of the HARDI distribution system must be preapproved by HARDI and a copy of the original invoice submitted with the warranty claim. These parts will be reimbursed at invoice cost and there will not be any consideration for customs, duty, freight, or brokerage fees to receive these parts.

Warranty for Approved Attachments

Warranty for approved attachments carry the warranty of their respective manufacturers and warranty claims should be submitted to the respective manufacturers such as but not limited to tyres, engines, transmissions etc.

Dealer Obligations

• Receiving Inspection to be performed when the machine arrives at the dealership. Any damage to the machine must be resolved with the trucking company. Any missing items must be noted on the receiving inspection or short shipment report. Inspection reports must be sent to HARDI within three (3) days, of the receiving date. Reports that are received late will not be considered for assistance with any missing items.
• Transport Inspections to be performed prior to machines leaving the dealership. Copies to be sent to HARDI within 30 days of inspection date. All information must be complete.
• Delivery Installation & Warranty Registration to be completed, signed, and sent to HARDI within 14 days of delivery or installation. A delivery / warranty registration is required each time a machine is demonstrated. Without this the warranty cannot be paid.
• Privacy statement and consent form to be completed signed and sent to HARDI within 14 days of delivery or installation.
• Safety Acknowledgement form to be completed, signed and sent to HARDI within 14 days of delivery or installation.
